    Rights in Collecting Debts

    • Businesses have the right to start collections when a debtor falls behind on payments. Businesses have the right to hire bill collectors. Businesses can sell their past due accounts and uncollected accounts receivables to debt collectors. Businesses that sell goods or equipment on credit can collect the property they sold on credit if payments are missed.

    Rights on Owed Debts

    • Businesses have the same rights as individuals when pursued for unpaid debt. The business and its acting representatives have the right to receive past due notices and collection lawsuits. Business debt collectors cannot harass or threaten either the business owner or the business' employees.

    Business Debt Collections for Personally Held Debt

    • Small businesses may be started by individuals taking on debt in their own name. If the business goes bankrupt, the debt collectors can seek collections from the individual. If the individual goes bankrupt, personal and business assets can be targeted for collections.
