- 1). Find out the person's name. The actual name of the person is necessary to perform a criminal record check. You cannot use an alias or nickname.

- 5). Use the criminal record check according to local, state and federal law. According to the U.S. Chamber of Commerce,"Some states restrict checks of criminal records to those employers who are checking for specified reasons. Some states even prosecute employers that violate laws preventing criminal record disclosure."
