- 1). Study all local and state rules of civil procedure necessary for filing a complaint in your jurisdiction. Some courts require that specific forms, language and procedures be used when filing a complaint.
- 2). Determine which cause of action in your jurisdiction most closely exemplifies how your rights have been violated. Intrusion upon solitude and seclusion and public disclosure of private facts are the most common causes of action.
- 3). Research how the best cause of action is interpreted in your jurisdiction and the types of considerations your state courts looks to when dealing with privacy disputes.
- 4). Draft a cover page to your complaint with the names of the parties, the case docket number, the name of the court you are filing in and any other information required by your local judiciary.
- 5). Draft a factual section to your complaint that explains how your privacy was violated and why you deserve relief from the court.
- 6). Set forth the legal basis for your argument by explaining how your factual situation is similar to one of the recognized causes of action for invasion of privacy. Use your case law research to support your position.
- 7). At the end of your complaint, state the type of relief you are requesting from the court and how you have been damaged by the invasion of privacy. Your jurisdiction may require that you state a general monetary range for the case, so be sure to check local rules.
- 8). File your complaint with the local department of court records. Be sure to bring extra copies and pay any associated filing fees.
