Laws About Employer Notification

    Fair Pay Notices

    • Under the federal Fair Labor Standards Act (FLSA) your employer is required to post notifications about your right to fair pay. Specifically, your employer must notify you of the current federal minimum wage, your right to overtime pay, and your rights if you work for tips.

    EEOC Notificiation

    • The Equal Employment Opportunity Commission (EEOC) is a federal agency that enforces numerous federal laws guaranteeing equal employment opportunities for all employees. Your employer must post a notice of certain EEOC information, including contact information for the EEOC. The notice must also describe the types of discrimination that are prohibited by the EEOC, such as discrimination based on disability, race, gender, age and religion.

    USERRA

    • USERRA, which is short for the Uniformed Services Employment and Reemployment Rights Act, requires employers to annually notify all their employees of the employees' rights under USERRA. The USERRA notification must be posted at the work place, and also must be sent to each employee.

    OSHA

    • OSHA stands for the Occupational Safety and Health Administration. OSHA requires employers to post notice of the employees' right to a safe workplace. The notice also must provide contact information for enforcing OSHA rights.

    FMLA

    • Employers must also post notice of employees' rights under the Family and Medical Leave Act (FMLA). Generally, this notice must describe FMLA rights to unpaid leave for family and medical emergencies, such as sick or injured family members, or pregnancy and child delivery.

    Employee Polygraph Protection Act

    • This notice must be posted in the workplace. This notice explains to employees that employers are prohibited from requiring polygraph, or lie detector, tests relating to your job.

    State Laws

    • Some states impose additional notification and posting requirements. Utah and other states, for example, require posting a notice about workers' compensation and unemployment insurance.
